JMG Design & Build recently completed the full design-build package for Happi Brew Main, a two-storey coffee shop construction project in Marawi City, Lanao del Sur. Commissioned by Amil Alonto and RJ Alonto, this project covers everything from architectural concept design to structural, electrical, plumbing, mechanical, and electronic/security working drawings — delivered as a complete, construction-ready document set under two proposal options.

About the Project

Happi Brew Main is designed as a modern two-storey commercial café building in Marawi City — an establishment built not just to serve great coffee, but to stand as a statement of quality in the local commercial landscape. The project was handled end-to-end by JMG Design & Build, ensuring that every drawing, every specification, and every cost estimate reflects the standard of work the client deserves.
The design takes full advantage of a two-storey layout: an open, welcoming ground-floor dining area with floor-to-ceiling glazing, a second-floor indoor dining space for a more intimate experience, and a signature alfresco terrace overlooking the surroundings. The architectural language is clean, contemporary, and built to age well.

JMG Design & Build has prepared two distinct engagement options for the Happi Brew Main project. Both options are based on the same approved architectural and structural design, the same DPWH 2024 unit rates, and the same above-average labor standards — the difference lies in who procures and supplies the materials.

Option A (Full Design & Build) — JMG handles everything: materials, labor, equipment, logistics, and project management. You get a single point of accountability, one contract, and a guaranteed turnkey outcome. This is our recommended path for most clients.

Option B (Manpower & PM Services Only) — JMG provides the workforce, supervision, and project management. You, the Owner, procure and supply all construction materials. This option works best when you have an established supplier network or require direct control over material specifications.

JMG Design & Build is pleased to present this Full Design & Build Proposal for the Proposed Two-Storey Coffee Shop Building — Happi Brew Main — located in Marawi City, Lanao del Sur. This engagement model represents our most comprehensive service offering: JMG assumes full responsibility for all materials, labor, equipment, logistics, and project management from mobilization to turnkey handover.

Under Option A, you make one decision — to build with JMG — and we handle the rest. You receive a fixed lump-sum price of PHP 3,981,633.48 (No VAT), a defined completion date, and a single point of accountability throughout the entire project lifecycle.

This proposal is based on the approved architectural and structural plans for a 10.90m × 6.00m two-storey reinforced concrete building with a Gross Floor Area of 130.80 square meters. All unit rates follow the DPWH 2024 Unit Price Guide, with Marawi remote-area premiums absorbed into all-in rates. No VAT is applied per project agreement.

Under Option A, JMG Design & Build assumes full responsibility for all of the following work packages. All materials are sourced, delivered, and installed by JMG. All labor is recruited, supervised, and managed by JMG.

01 — Site Preparation & Earthworks

Site clearing, grubbing, excavation, compaction, embankment fill (175 cu.m loose), and rough grading to finished subgrade elevation.

02 — Concrete Works

All footings, grade beams, columns, slabs, and beams per structural plans. Concrete mix design, batch plant coordination, pour schedules, and curing.

03 — Formwork & Scaffolding

Full formwork system for all RC elements — fabrication, erection, stripping, and reuse planning. Perimeter scaffolding for safe access.

04 — Rebar Works

Structural steel reinforcement — bar cutting, bending, tying, and placement per NSCP 2015. Bar schedule and BBS prepared before cutting.

05 — Masonry & Plastering

CHB laying for exterior (168 sqm) and interior (70 sqm) walls, plus full-building plaster application (476 sqm). Cement-sand mortar with proper curing.

06 — Roofing System

Structural steel purlins, roof framing, long-span metal deck or corrugated roof sheets, gutters, downspouts, and ridge caps. Weathertight installation.

07 — Architectural Finishes

Tile works (floor and wall), doors and windows with hardware, ceiling framing and board, interior and exterior painting — all per approved finishes schedule.

08 — Electrical Works

PEC 2017-compliant complete electrical installation: distribution panel, branch circuits, conduit roughing-in, wiring, outlets, switches, lighting fixtures, and grounding system.

09 — Plumbing Works

National Plumbing Code-compliant complete installation: water supply lines, drainage system, comfort rooms, sinks, floor drains, water meter connection, and septic tank.

10 — Logistics & Material Delivery

All CDO-to-Marawi freight for bulk materials via 10-ton closed van/wing van. Multiple delivery runs coordinated with construction phases to minimize idle time.

11 — Project Management

Licensed Project Engineer (5 months), Site Foreman, monthly progress reports, quality inspections, daily site logs, and complete as-built documentation at turnover.

12 — Turnkey Handover

Final punchlist, defect correction, cleaning, commissioning of electrical and plumbing systems, and formal turnover with as-built drawings and warranties.

Terms & Conditions
1

Contract Type & Pricing Basis

This is a lump-sum Design-Build contract. The contract price of PHP 3,981,633.48 is fixed and all-inclusive for the defined scope of work. No VAT is applied per project agreement. No additional charges for materials, labor, or logistics within the agreed scope.

Scope Variations

Any Owner-initiated additions, deletions, or modifications to the agreed scope will be subject to a written Change Order and price adjustment. JMG will provide cost estimates within 5 business days of any variation request. Works do not proceed without Owner sign-off on the Change Order.

Owner’s Responsibilities

The Owner shall: (a) secure all building permits and government clearances prior to NTP; (b) provide clear, unobstructed site access; (c) release payments within 5 banking days of milestone certification; (d) provide written NTP before construction commencement.

Validity Period

This proposal is valid for thirty (30) calendar days from the date of issue. After September 17, 2026, prices are subject to revision based on material and labor market conditions. JMG reserves the right to re-price should material costs move by more than 5% from current benchmark rates.

Defect Liability & Warranty

JMG warrants all workmanship and supplied materials for one (1) year from the date of turnover. Any structural or material defects attributable to JMG will be corrected at no additional cost to the Owner. Defects caused by Owner misuse, unauthorized alterations, or force majeure are excluded.

Force Majeure

Neither party shall be in default for delays caused by events beyond reasonable control, including but not limited to natural disasters, civil unrest, government-mandated lockdowns, or declared state of calamity. Both parties will negotiate a reasonable schedule extension in good faith.

Payment Default

If the Owner fails to release payment within fifteen (15) calendar days of milestone certification, JMG may suspend construction without penalty until payment is received. Resulting delays due to payment suspension will extend the project completion date accordingly and are not attributable to JMG.

By signing below, the Owner confirms acceptance of this Proposal

This constitutes the Owner’s intent to proceed with Option A — Full Design & Build at the contract price of PHP 3,981,633.48 (No VAT) under the terms and conditions outlined herein. A formal Construction Contract (JMG-CON-OPA-2026-MRW-001) will be executed as the binding legal instrument. This accepted proposal serves as a Letter of Intent until the contract is signed.

Recitals
Background & Recitals

WHEREAS, the Owner intends to construct a Proposed Two-Storey Coffee Shop Building — Happi Brew Main — located in Marawi City, Lanao del Sur, Philippines (the “Project”);

WHEREAS, the Contractor is a duly organized construction enterprise engaged in building construction, design-build, and project management services in the Philippines;

WHEREAS, the Owner desires to engage the Contractor under a Full Design-Build arrangement, wherein the Contractor provides all labor, materials, equipment, and logistics required to complete the Project from mobilization to turnkey handover;

WHEREAS, the Contractor has prepared and submitted a detailed Bill of Quantities (BOQ Ref: JMG-2026-MRW-001-R3) and Project Proposal (Ref: JMG-PPA-2026-MRW-001), which the Owner has reviewed, approved, and accepted;

NOW THEREFORE, in consideration of the mutual covenants herein and for good and valuable consideration, the parties agree as follows:

Article I
Scope of Work
1.1
The Contractor agrees to furnish all labor, materials, equipment, tools, transportation, supervision, and related services necessary to complete the construction of the Proposed Two-Storey Coffee Shop Building — Happi Brew Main, in Marawi City, Lanao del Sur, in accordance with the approved plans, specifications, and the Bill of Quantities (Ref: JMG-2026-MRW-001-R3).

The full scope includes, but is not limited to: site preparation and earthworks; reinforced concrete foundations, columns, beams, and slabs; formwork and scaffolding; structural steel reinforcement; masonry and plastering; roofing system; architectural finishes (tile, paint, doors, windows, ceiling); complete electrical installation (PEC 2017-compliant); complete plumbing installation (National Plumbing Code-compliant); CDO-to-Marawi material logistics; and project management for the duration of construction.

The Contractor warrants that all materials supplied shall be of good quality, appropriate grade, and consistent with the specifications referenced in the approved BOQ. No substitution of specified materials shall be made without prior written consent from the Owner.

Items Excluded from Scope: land acquisition and titling costs; building permit fees and government processing charges; furniture, fixtures, and equipment (FF&E) beyond those listed in the BOQ; utility connection and meter installation fees; and any works specifically identified as Owner-supplied in the approved scope matrix.

Lump-Sum Fixed Price
2.1
The Owner agrees to pay the Contractor a total lump-sum price of Philippine Pesos Three Million Nine Hundred Eighty-One Thousand Six Hundred Thirty-Three and 48/100 (PHP 3,981,633.48) for the full completion of the defined scope of work. No Value Added Tax (VAT) is applied per the parties’ agreement.
2.2
This contract price is fixed and all-inclusive for the approved scope. It shall not be adjusted except through a written, mutually-signed Change Order as provided in Article VIII of this Contract.
2.3
The contract price is based on DPWH 2024 Unit Price Guide rates, above-average labor rates with Marawi remote-area premium (+12%) absorbed into all-in daily rates, and CDO-sourced material pricing as of the date of BOQ preparation.
Article III
Payment Schedule
3.1
Payment shall be released in five (5) tranches tied to construction milestones as follows:

3.2
Milestone completion shall be certified in writing by the Contractor’s Project Engineer. The Owner shall release payment within five (5) banking days of receiving the written milestone certification. Billing shall be accompanied by progress photographs and a brief status report.
3.3
If payment is delayed beyond fifteen (15) calendar days from the due date without written justification from the Owner, the Contractor reserves the right to suspend construction activities. Any resulting schedule delays due to payment suspension shall extend the project completion date accordingly and shall not be attributed to the Contractor.
3.4
All payments shall be made via bank transfer or manager’s check payable to JMG Construction & General Merchandise. Cash payments will be acknowledged through official receipts issued by the Contractor.
Article IV
Time of Completion
4.1
The Contractor shall commence construction on or before the date specified in the written Notice to Proceed (NTP) issued by the Owner, provided that the 20% mobilization payment (₱796,326.70) has been received by the Contractor. The Contractor shall mobilize within seven (7) to ten (10) calendar days of receiving both the NTP and mobilization payment.
4.2
The proposed NTP date is September 1, 2026. The target project completion date is January 30, 2027 — a construction period of approximately twenty-two (22) weeks, exclusive of force majeure and Owner-caused delays.
4.3
The project schedule is detailed in the companion Gantt chart (Ref: JMG-SCH-OPA-2026-MRW-001). Both parties acknowledge that the schedule may be adjusted by mutual written agreement without invalidating this Contract.
4.4
Time extensions shall be granted for: (a) Owner-directed scope changes; (b) payment delays beyond 15 days causing a work suspension; (c) force majeure events; (d) Owner failure to provide timely access, decisions, or approvals. Extensions shall be formalized through a written Time Extension Order signed by both parties.
Article V
Contractor’s Obligations
5.1
Workmanship Quality: The Contractor shall perform all work in a professional and workmanlike manner, in accordance with NSCP 2015, PEC 2017, the National Plumbing Code of the Philippines, and DPWH standard specifications.
5.2
Licensed Personnel: The Contractor shall assign a licensed Professional Engineer or Civil Engineer as Project Engineer, and a qualified Site Foreman, for the full duration of construction.
5.3
Progress Reporting: The Contractor shall submit a written monthly progress report by the 1st business day of each month, including: work accomplished, upcoming activities, issues encountered, and photographic documentation.
5.4
Site Safety: The Contractor is responsible for maintaining a safe working environment on site. All workers shall be provided with appropriate PPE. The Contractor shall comply with DOLE occupational safety standards for construction.
5.5
Material Control: The Contractor shall source and use only materials of specified quality. The Owner may inspect materials before and during installation. Non-conforming materials shall be removed and replaced at no additional cost.
5.6
As-Built Documentation: Upon turnover, the Contractor shall provide complete as-built drawings (architectural, structural, electrical, plumbing), operating manuals for installed systems, and warranty certificates for supplied materials and equipment.
Article VI
Owner’s Obligations
6.1
Permits & Clearances: The Owner is responsible for securing all required building permits, barangay clearances, and government approvals prior to the issuance of NTP. No NTP shall be issued until the building permit is presented to the Contractor.
6.2
Site Access: The Owner shall provide clear, legal, and unobstructed access to the project site at all times during normal working hours. Any access disputes or restrictions shall be resolved by the Owner promptly.
6.3
Timely Payments: The Owner shall release each payment tranche within five (5) banking days of receiving the written milestone certification. Delayed payments directly affect the project schedule.
6.4
Timely Decisions: The Owner shall respond to Contractor requests for decisions, approvals, or clarifications within five (5) business days. Delays in Owner decisions that affect the construction schedule shall be documented and may entitle the Contractor to a time extension.
Article VII
Defect Liability & Warranty
7.1
The Contractor warrants all workmanship and materials supplied under this Contract for a period of one (1) year from the date of formal turnover (the “Defect Liability Period”). Any defects in workmanship or supplied materials identified during this period shall be corrected by the Contractor at no additional cost to the Owner.
7.2
The warranty does not cover defects arising from: (a) Owner misuse or unauthorized modifications; (b) normal wear and tear; (c) force majeure or natural disasters; (d) acts of third parties not engaged by the Contractor.
7.3
The Owner shall notify the Contractor in writing of any warranty claim. The Contractor shall inspect and respond within five (5) business days. Confirmed warranty defects shall be remediated within a reasonable time as agreed by both parties.
Article VIII
Change Orders & Scope Variations
8.1
Any change to the scope of work — additions, deletions, or modifications — must be authorized through a written Change Order signed by both parties before work begins on the variation. No verbal or email-only authorizations are binding.
8.2
The Contractor shall provide a written cost estimate for any proposed change within five (5) business days of the Owner’s request. The estimate shall reference DPWH 2024 unit rates. Both parties shall negotiate in good faith before executing the Change Order.
8.3
Approved Change Orders shall specify: description of work, adjusted price (addition or deduction), and any schedule impact. The cumulative effect of all Change Orders shall be added to or deducted from the original contract price.
Article IX & X
Force Majeure & Dispute Resolution
Article IX — Force Majeure
9.1
Neither party shall be held in default or liable for delays or failures in performance caused by events beyond their reasonable control, including but not limited to: natural disasters (earthquake, flooding, typhoon), declared state of calamity or emergency, civil unrest, national or local government-mandated lockdowns, or acts of God.
9.2
The affected party shall provide written notice of the force majeure event within five (5) business days. Both parties shall negotiate in good faith a reasonable schedule extension and, if necessary, a price adjustment for any additional mobilization or standby costs incurred.
Article X — Dispute Resolution
10.1
The parties shall make every reasonable effort to resolve disputes amicably through direct negotiation within fifteen (15) calendar days of written notice of a dispute. If negotiation fails, the dispute may be referred to a mutually-agreed mediator or submitted to the appropriate court of jurisdiction in the Philippines.
10.2
This Contract shall be governed by and construed in accordance with the laws of the Republic of the Philippines. The parties consent to the exclusive jurisdiction of the appropriate Philippine courts for any dispute arising from this Contract.

Under Option B, JMG provides the complete workforce, project management, and logistics for workers. The Owner is responsible for procuring, funding, and delivering all construction materials, equipment, and tools to site. Executive Summary

JMG Design & Build is pleased to present this Manpower & Project Management Services Proposal for the Proposed Two-Storey Coffee Shop Building — Happi Brew Main — in Marawi City, Lanao del Sur. Under Option B, JMG provides a complete, professional workforce and management team while the Owner retains full control of material procurement.

Under Option B, JMG’s role is to deploy the right team, manage the process, and build correctly — using the materials you supply. The total service fee is PHP 1,950,000.00 (No VAT) — a lump-sum, fixed price for all labor, supervision, worker logistics, and project management from mobilization to handover.

This proposal is built on the same approved architectural and structural plans and the same DPWH 2024 labor rate standards as Option A. The only difference is that you, the Owner, control material sourcing. JMG’s labor rates include the Marawi remote-area premium (+12%) absorbed into all daily rates — workers are paid above-average, ensuring you attract and retain experienced craftsmen on your project.

Under Option B, responsibilities are clearly divided between JMG and the Owner. Understanding this split before signing protects both parties and keeps the project on schedule.

JMG will inspect all materials upon delivery and may reject substandard materials that do not meet the project specifications. Delivery delays caused by material shortages on the Owner’s side will extend the project schedule accordingly.

Scope of Labor Services

JMG’s labor team will execute all of the following activities using materials supplied by the Owner.

Earthworks & Site Prep

Site clearing, excavation, compaction, embankment fill (175 cu.m), and rough grading per structural drawings.

Concrete Works

Form, reinforce, pour, and cure all footings, grade beams, columns, beams, and slabs on both floors.

Formwork & Scaffolding

Fabrication, erection, and stripping of all formwork for RC elements. Scaffolding erection and dismantling.

Rebar / Structural Steel

Bar cutting, bending, tying, and placement per bar schedule. Steel column installation and welding where required.

Masonry & Plastering

CHB laying (168 sqm exterior + 70 sqm interior) and full plastering (476 sqm) on both floors.

Roofing Installation

Structural steel purlin setting, roofing sheet installation, gutters, downspouts, and ridge caps.

Doors & Windows

Frame installation, door hanging, window setting, and hardware installation per schedule.

Tile Works

Floor and wall tile setting (with materials supplied by Owner). Waterproofing integration for wet areas.

Ceiling Works

Ceiling frame fabrication and board installation per approved ceiling plan.

Painting

Surface preparation, primer, and finish coat application — interior and exterior, all surfaces.

Electrical Installation

PEC 2017-compliant rough-in, wiring, panel installation, fixture mounting, and testing.

Plumbing Installation

Water supply and drainage rough-in, fixture installation, pressure testing per National Plumbing Code.

Key Terms & Conditions
1

Lump-Sum Labor Contract

This is a fixed lump-sum for all labor, supervision, worker logistics, and project management. No VAT is applied. The fee does not cover any materials, equipment, or tools.

Material Supply is Owner’s Responsibility

All construction materials must be procured, funded, and delivered to site by the Owner per the project schedule. JMG is not responsible for delays caused by material shortages or late deliveries. Such delays will extend the completion date and are not attributable to JMG.

Material Quality Inspection

JMG’s Project Engineer will inspect all materials upon delivery. Non-conforming materials will be flagged in writing. JMG reserves the right to refuse installation of materials that do not meet specified standards — doing so protects both parties from defects and liability.

Defect Liability — Workmanship Only

JMG’s one (1) year warranty under Option B covers workmanship only. Material defects are the responsibility of the material supplier or the Owner’s procurement choices. JMG will correct installation-related defects at no charge within the warranty period.

Validity & Scope Changes

This proposal is valid for 30 days from issuance. Any scope changes (additions or deletions in labor scope) require a written Change Order. Labor rate adjustments due to market escalation after 90 days from NTP may be subject to renegotiation.

This confirms intent to proceed with Option B — Manpower & PM Services Only at a total service fee of PHP 1,950,000.00 (No VAT). A formal Manpower & PM Services Contract (JMG-CON-OPB-2026-MRW-001) will be executed as the binding instrument.

Background & Recitals

WHEREAS, the Owner intends to construct a Proposed Two-Storey Coffee Shop Building — Happi Brew Main — located in Marawi City, Lanao del Sur, Philippines (the “Project”);

WHEREAS, the Owner has elected to procure and supply all construction materials directly and desires to engage the Contractor solely for manpower, skilled labor, project management, and related logistics services;

WHEREAS, the Contractor has submitted a Manpower & PM Services Proposal (Ref: JMG-MPS-2026-MRW-001-R1) which the Owner has reviewed, approved, and accepted at a total lump-sum service fee of PHP 1,950,000.00;

NOW THEREFORE, in consideration of the mutual covenants herein, the parties agree as follows:

Article I
Scope of Services
Article I — Contractor’s Scope of Services
1.1
The Contractor agrees to provide all skilled labor, general labor, supervision, project management, and worker logistics necessary to construct the Happi Brew Main Two-Storey Building, using materials supplied by the Owner, in accordance with the approved architectural and structural plans referenced in this Contract.
1.2
Labor Scope Includes: Site preparation and earthworks (labor only); concrete works — forming, reinforcing, pouring, and curing; masonry (CHB laying — exterior 168 sqm, interior 70 sqm); plastering (476 sqm); roofing sheet installation and metal works; doors and windows installation; tile setting (floor and wall); ceiling works; painting; PEC 2017-compliant electrical rough-in, wiring, and fixture installation; National Plumbing Code-compliant plumbing rough-in and fixture installation; and final commissioning, punchlist correction, and project turnover preparation.
1.3
Management Scope Includes: One (1) Licensed Project Engineer on-site for the full construction duration; one (1) qualified Site Foreman; monthly written progress reports; quality inspection logs; coordination of worker mobilization and demobilization; and preparation of as-built documentation upon project completion.
1.4
Logistics Scope Includes: Worker transportation between Cagayan de Oro (CDO) and Marawi City (estimated 20 round trips at ₱3,500 per trip); and worker accommodation in Marawi City for a duration of five (5) months (₱28,000/month).
1.5
Exclusions from Contractor’s Scope: All construction materials (cement, rebar, aggregates, CHB, roofing materials, finishing materials, electrical materials, plumbing materials); construction equipment and power tools; scaffolding materials (unless included in the approved labor scope breakdown); and material delivery logistics from suppliers to site.

2.1
The Owner agrees to pay the Contractor a total lump-sum service fee of Philippine Pesos One Million Nine Hundred Fifty Thousand and 00/100 (PHP 1,950,000.00) for the complete labor and project management services described herein. No Value Added Tax (VAT) is applied per the parties’ agreement.
2.2
This service fee is fixed and covers all labor costs, management fees, worker transportation, and worker accommodation as itemized in the companion Manpower Proposal (Ref: JMG-MPS-2026-MRW-001-R1). Materials, equipment, and tools are explicitly excluded and remain the Owner’s responsibility.
2.3
Service fee adjustments may be negotiated if the approved labor scope is materially changed by the Owner, or if material delays caused by the Owner’s supply chain necessitate prolonged worker standby beyond what is absorbed in the lump-sum. Any adjustment requires a written Change Order signed by both parties.
Article III
Payment Schedule
3.1
Payment shall be released in five (5) tranches tied to labor deployment milestones as follows:

3.2
Payment shall be released within five (5) banking days of the Contractor’s written milestone certification accompanied by progress photographs. Delays beyond fifteen (15) calendar days may result in a work suspension as provided in Article VI of this Contract.
3.3
Milestone certifications reflect the completion of labor activities only. If a milestone is delayed due to material shortages on the Owner’s part, the Contractor may certify partial completion of labor work completed to date, and the Owner shall release a proportionate partial payment as negotiated in good faith.
Articles IV, V & VI
Time of Completion, Obligations & Material Responsibility
Article IV — Time of Completion
4.1
The Contractor shall mobilize within seven (7) to ten (10) calendar days of receiving both the written NTP and the 20% mobilization payment (₱390,000.00). Proposed NTP: September 1, 2026. Target completion: January 16, 2027 (approximately 20 weeks), subject to timely material supply by the Owner.
4.2
The project schedule (Ref: JMG-SCH-OPB-2026-MRW-001) is predicated on continuous material availability on site. Any delay in material delivery that causes workers to be idle for more than two (2) consecutive working days will extend the schedule by an equivalent period. Idle days beyond five (5) consecutive days may entitle the Contractor to a standby fee not exceeding the daily payroll cost of affected workers.
Article V — Contractor’s Obligations
5.1
Quality of Work: All labor shall be performed in a professional and workmanlike manner per NSCP 2015, PEC 2017, National Plumbing Code, and DPWH specifications — regardless of whether materials are supplied by the Owner or JMG.
5.2
Material Inspection: The Contractor’s Project Engineer shall inspect all materials upon delivery and document any non-conformance in writing. The Contractor shall not install materials flagged as non-compliant until the Owner addresses the deficiency. The Contractor bears no liability for defects arising from substandard materials supplied by the Owner.
5.3
Worker Safety & Conduct: JMG is responsible for worker PPE, labor law compliance (DOLE), and site safety protocols for all JMG-deployed workers. The Owner is responsible for site perimeter security and overall site safety conditions.
5.4
Defect Liability: JMG warrants all workmanship for one (1) year from turnover. This warranty covers installation-related defects only. It explicitly excludes defects caused by substandard materials, Owner modifications, or normal wear and tear.
Article VI — Owner’s Critical Obligations
6.1
Timely Material Supply: The Owner shall ensure all required materials are on site and ready for installation at least 48 hours before each activity phase begins, per the agreed program of works. Failure to supply materials on time is a breach of the Owner’s obligation and absolves JMG of schedule accountability for the corresponding delay.
6.2
Temporary Power, Water & Equipment: The Owner shall provide and maintain temporary electricity, water supply, and any construction equipment listed in the approved scope. JMG workers cannot proceed without access to these utilities.
6.3
Permits & Access: The Owner shall secure all building permits and government clearances prior to NTP. The Owner shall ensure clear, legal site access throughout the project duration.
6.4
Timely Payments: Milestone payments shall be released within five (5) banking days of certification. Delays beyond fifteen (15) calendar days entitle the Contractor to suspend work without penalty until payment is received.
Articles VII–X
Change Orders, Force Majeure, Termination & Disputes
Article VII — Change Orders
7.1
Any change to the labor scope requires a written Change Order signed by both parties before work begins. The Contractor will provide a cost estimate within five (5) business days. Changes shall be priced at the same DPWH 2024 labor rate basis plus applicable OCM and profit.
Article VIII — Force Majeure
8.1
Neither party shall be in default for delays caused by events beyond reasonable control (natural disasters, civil unrest, government lockdowns, declared calamity). Affected party shall notify in writing within five (5) business days. Resulting schedule extensions shall be negotiated in good faith.
Article IX — Termination
9.1
Either party may terminate this Contract with fourteen (14) calendar days written notice for material breach that remains uncured ten (10) days after written notice of the breach. Upon termination, the Contractor shall be compensated for all labor services rendered to date plus reasonable demobilization costs. The Owner shall not use incomplete work without paying for all services completed.
Article X — Dispute Resolution & Governing Law
10.1
Disputes shall first be resolved through direct negotiation within fifteen (15) calendar days of written notice. If unresolved, parties may submit to mediation or the appropriate Philippine court of jurisdiction. This Contract is governed by the laws of the Republic of the Philippines.
